This book brings together essays on themes of human rights and legal history, reflecting the long and distinguished career as academic writer and human rights activist of Brian Simpson. Written by colleagues and friends in the United States and Britain, the essays are intended to reflect Simpson's own legal interests. The collection opens with biography of Simpson's academic life which notes his major contribution to legal thought, and closes with an account of his career in the United States and a (...) bibliography of his writings. As a tribute to Simpson's varied interests in the law, the collection is grouped around themes in human rights, legal philosophy, and legal history. The human rights papers are concerned with the history of the right of individual petition to the European Court of Human Rights, and recent successes in which Brian Simpson played a part; the evolution of a transnational common law of human rights; the United Nations Convention on the Rights of the Child and the interpretation of the provisions on identity in France and England; the suspension of human rights which would have occurred, had the emergency War Zone Courts scheme been brought into effect during wartime; historical resistance to colonial laws in Papua New Guinea; and the ratio decidendi of the story of the Prodigal Son. Beyer, seither vom jeweils amtierenden Vorstand der Gesellschaft herausgegeben. Seit 1994 erscheint das Jahrbuch im Akademie Verlag. Es dokumentiert die Beiträge der Internationalen Hegel-Kongresse, die alle zwei Jahre zu wechselnden Schwerpunktthemen stattfinden.

A Hegel-Congress of the Internationale Hegel Vereinigung took place at Stuttgart in May 1975; it was organised together with the Heidelberger Akademie der Wissenschaften, the Schelling-Kommission of the Bayerische Akademie der Wissenschaften and the city of Stuttgart. It proved a success. First it was not just a high and dry academical meeting of specialists, but it attracted more than 900 people and we had interested and sometimes heated discussions on major contemporary problems. It was also a success to bring together (...) philosophers from both Western and Eastern Europe, as a result of the patient endeavors of Prof. D. Martin Buber is considered one of the 20th centuryes greatest thinkers and his contributions to philosophy, theology and education are testimony to this. His thought is founded on the idea that people are capable of two kinds of relations, namely I-Thou and I-It, emphasising the centrality of dialogue in all spheres of human life. For this reason, Buber is considered by many to be the philosopher of dialogue par excellence. After Buberes death the appreciation of his considerable legacy to the (...) various disciplines in which he had worked became rather muted, but was never completely forgotten. There is now a renewed and growing interest in Buberes thought, especially in his philosophy of education. This book brings together aspects of Buberes philosophy and educational practice, and explains their significance for peace dialogue and for conflict resolution, both between individuals and communities. Buber's philosophy of dialogue and views on education are pivotal in demonstrating the personal and social benefits of dialogical education as well as the dangers of non-dialogical education. New York: Continuum, 1997. 306 pp.Ever since the landmark meeting of Thomas Merton and the Dalai Lama in 1968, the Christian and Buddhist contemplative communities have been building toward the kind (...) of deeply spiritual encounter that is so ably narrated in this book. For five days in July of 1996, a pantheon of advanced spiritual practitioners, led by the Dalai Lama, met at Thomas Merton’s monastery in Kentucky to dialogue on the spiritual life. The resulting exchanges provided not only mutual aid on the spiritual journey but were themselves a spiritual path. In recounting this meeting, The Gethsemani Encounter marks a watershed in the spiritual dialogue between Christianity and Buddhism. [End Page 232]A history of interfaith contacts and the deeply spiritual character of intermonastic dialogue prepared the way for the success of this historic encounter. In 1978, ten years after the death of Thomas Merton, two dialogue commissions were created: the “Monastic Interreligious Dialogue” (MID) in North America, and the “Dialogue Inter-Monastic” (DIM) in Europe. These commissions fostered a rapid expansion in the number of nuns and monks engaged in interfaith dialogue. Christian monastics spent time living in Tibetan and Zen monasteries in the East, and Buddhist nuns and monks were guests of Christian monasteries in the West. These encounters gradually evolved into a profound discussion of the spiritual life in all its nuances and its implications for humankind.The inspiration for the Gethsemani Encounter came from the Dalai Lama. At the Parliament of the World’s Religions in 1993, during a morning session on “Emptiness and Kenosis,” the Tibetan leader suggested that the conversation continue in a monastic setting. His idea was to gather a small group of mature Buddhist and Christian monastics who are teachers of spirituality. They would dialogue about the practice of spirituality and its value for the world in a setting where they could also live, meditate, and celebrate together.A variety of Buddhists reflecting the diversity of contemporary Buddhist practices were invited to Gethsemani. These included Theravadin, Zen, and Tibetan monks from Asia and lay leaders from the emerging American Buddhist communities. Efforts were made to include women’s voices from each tradition. Most of the Buddhists who came to Gethsemani were living in Buddhist communities in the United States. The hope was that this meeting would catalyze future local encounters between Buddhist and Christian spiritual communities.The Christian monastics were primarily drawn from Benedictine and Trappist MID board members or advisors from Europe, North America, Asia, and Australia. Invited as well were the abbot general of the Trappist Order, the head of the Vatican’s Pontifical Council for Interreligious Dialogue, and Bishop Joseph Gerry, O.S.B., to represent the National Conference of Catholic Bishops. The MID advisors also included some priests and lay practitioners—Catholic and Protestant—with experience in Buddhist dialogue. The existentialist philosopher Karl Jaspers is the father of a discourse on the spiritual consequences of the Holocaust. First addressed as the Schuldfrage (the question of guilt) by Jaspers immediately after the Second World War in his famous Heidelberg lecture, it has reappeared in various forms in German life and letters. Post-unification Germany has witnessed the valorization of the German experience of the Second World War. This ongoing re-evaluation has its antecedents in the generational literature of the 1970s and 1980s. (...) Whereas the Vaterliteratur of the 1970s (by authors such as Christoph Meckel, Uwe Timm, and Peter Henisch) was often embedded in a left-wing critique of the establishment, recent contributions to this growing genre (by Marcel Beyer, Stephan Wackwitz, Wibke Bruhns, and Ulla Hahn among others) speak to the issue of collective identity and transgenerational family trauma outside distinct left- and right-wing interpretations of National Socialism. The current writings on the life during the Third Reich (filtered through the experiences of discrete generations) are a confluence of historical writing, memorial literature, biography, and fiction. They are closely related to the discussions that W. G. Sebald initiated in his 1997 lecture series on the silence of German postwar literature with respect to German suffering. The subsequent debate on how to bring closure to this ?German suffering? was intensified by Günter Grass's widening of the concept of German victimization beyond the air war controversy in his book Crabwalk (2002). As Grass distinguishes clearly between the various post-World War II generations (and their different perspectives on historical events), the question becomes whether these recent writings will bring about a final so-called ?zero hour? in German postwar history. This paper argues that a strong thesis of divine providence, whereby God is understood as in complete control of all things, entails pantheism, the thesis that the universe is not ontologically distinct from God. In normal discourse, we distinguish a plan from, on the one hand, the state of affairs which realizes that plan—its execution or expression—and, on the other hand, the person or group whose plan it is. However, with respect to an omnipotent God who displays complete providence, neither (...) of these two distinctions holds. We cannot separate person from plan, or plan from world, and in consequence, neither can we separate person from world, ergo pantheism. Accordingly, the argument of this paper comes in two parts maintaining, first, the impossibility of distinguishing between God’s plan and its execution and, second, the impossibility of distinguishing God himself from his plan. WellsCatholic and Buddhist priests, monastics, teachers, and community leaders participated in the second of an anticipated four annual dialogues. The series is sponsored by the Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB). The conference took place 4–7 March 2004 at Mercy Center in Burlingame, CA, whose own East-West (...) meditation program, led by Fr. Thomas Hand, celebrated its twentieth anniversary that year. A popular retreat center and home to the Sisters of Mercy of Burlingame, the Center offered participants tree-dotted, spacious grounds and strolling paths, as well as a labyrinth for contemplative walking.Each day began with both Catholics and Buddhists in Mercy Center's Rose Room, a Zen-style meditation space, for an hour of silent meditation in the morning. Catholic liturgy was celebrated in the afternoon in the main chapel, with all participants invited to attend and share prayer and blessings. On the two full days, Friday and Saturday, two sessions of presentations were held each morning, with one session following in the afternoon. Each of the six sessions focused on a position paper, with three papers given from a Buddhist and three from a Christian perspective. Each paper was presented by its authors, followed by two formal responses, one by a Buddhist and one by a Catholic participant. This was in turn followed by an open discussion within the whole group. A minute of silent meditation began and ended each session.The presentations focused on various meanings embraced by the term "precepts" in each tradition. One paper introduced perspectives on Buddhist precepts in three different Buddhist lineages. Another presented six guidelines as "Precepts on the [End Page 155] Mind-Ground" that connect ethical commitments with social engagement. A third paper focused on Bodhisattva practice, which embraces and unifies all sentient beings. On the Christian side, presentations discussed the precepts as signposts on the path that leads away from suffering, as motivations that move us, and as the practice of the presence of God, exemplified by the writings of Brother Lawrence.A glossary prepared by Fr. Francis Tiso helped define Catholic Christian terms for the Buddhist participants in the dialogue. Similarly, a book distributed to all participants by the Dharma Realm Buddhist Association provided background on "Buddhism A–Z." Formal discussion sessions in the evenings, as well as informal talks by the participants while walking outside or in the form of impromptu hallway meetings added to the depth and richness of the dialogue. Some recurring themes were the importance and meaning of a personal teacher in both traditions; another was the "embodiment" of the teachings, the value of teaching through presence. Personal stories and practical experiences offered by individual participants were much appreciated and added poetry and emotion to the headiness of theological discussion.Members of both the Buddhist and the Catholic traditions reported that the encounter with the spiritual practices and beliefs of the other faith provides both affirmation of the familiar and welcome discovery of unexpected riches of the spirit. This essay explores the faultlines, poetic pressures and social structures of feeling determining poetry “after” Hiroshima. Nuclear bombs, accidents and waste pose theoretical and poetic challenges. The argument outlines a model of nuclear implicature that reworks Gricean conversational implicature. Nuclear implicature helps to describe ways in which poems “represent” nuclear problems implicitly rather than explicitly. Metonymic, metaphorical, and grammatical modes of implication are juxtaposed with recognition of social attitudes complicit with nuclear problems. Mushroom and lichen metaphors are analysed and distinguished. (...) There are brief accounts of The Chernobyl Herbarium, The Nuclear Culture Source Book and poems by Aidan Semmens, Lorine Niedecker, George Oppen, Denise Levertov, Adrienne Rich, Allen Ginsberg and Gerry Loose. The argument attempts to keep open the fragile agency of writing in poems that confront nuclear power. Poetry after Hiroshima is also contrasted with Adorno’s provocative questions about poetry after Auschwitz, amid Cold War arguments that have distorted recognition of the reality of nuclear production. The essay concludes by considering the emergence of poetry within E.P. Thompson’s theoretical account of “Exterminism,” sketching ways in which poetics and theory might inform both the nuclear imagination and the difficulties of nuclear song. (shrink)

The genetically-modified-organism (GMO) experience has been prominent in motivating science, industry, and regulatory communities to address the social and ethical dimensions of nanotechnology. However, there are some significant problems with the GMO-nanotech analogy. First, it overstates the likelihood of a GMO-like backlash against nanotechnology. Second, it invites misconceptions about the reasons for public engagement and social and ethical issues research as well as their appropriate roles in nanotech research, development, application, commercialization, and regulatory processes.
